About Tivoli by the Sea
Three condominiums wear this one name, and the corporate register dates them further apart than the matching stucco suggests. Florida's division of corporations carries Tivoli by the Sea Condominium Association, filed April 15, 1986, then a second association filed April 4, 1991, and a third on November 30, 1992, all still active. A community usually described as a single mid-1980s buildout is really seven years of separate filings, which means separate declarations, separate budgets and separate reserve clocks behind facades that read as one project. The assessment roll draws the same three lines, and drawing them is what makes this community countable at all. It records eighty-four residences here, numbered 5220 through 5303 on Tivoli Way and Tivoli Drive, sorted into three parcel-number series of twenty-eight, thirty-two and twenty-four, and the third series also carries a common area parcel recorded to the third association. The names on those parcels do not agree with one another: some read Tivoli by the Sea, some read only Condo Unit and a phase number, and several run past the length the roll prints, so a search by name reaches barely three fifths of the community and the series are what hold it together. Golf ground reaches the community on two sides, and the roll places those fairways inside the Baytowne Golf Course parcel owned by the resort's corporate owner, so the outlook crosses the company's land rather than the community's. Water is close on one side only: Horseshoe Lake, about fourteen acres, is mapped roughly six hundred feet west, while the Gulf is far enough off that other owners' parcels fill the ground between. The federal flood map places every one of these residences in Zone X, outside the special flood hazard area.
HOA & Fees
Match a residence to its own association before reading anything else, because three of them share this name, the first and the last chartered more than six years apart, and the declarations, budgets and reserve schedules follow the charter rather than the name. Each falls under Florida's condominium chapter, where budgets adopted from the last day of 2024 onward can no longer skip the reserve lines a structural integrity study identifies, so ask all three how their studies landed and expect three different answers on stucco, roofs and paving. Sandestin's master assessment arrives on top and separately, paying for resort security, sanitation, roadway and drainage upkeep, landscape, lakes and the two pools it runs elsewhere on the property. What the resort company owns, beach service and the beach club among it, is sold as membership and funded by neither of those.
Rental Policy
Three sets of recorded restrictions carry this name, so any sentence beginning with what Tivoli by the Sea permits is already wrong. Identify the association governing the residence, which its parcel number will tell you, read that association's current declaration and rules, and add Walton County's registration requirements before a calendar is assumed. Where paying guests are hosted, state lodging law adds paperwork of its own. Section 509.2112 reaches a public lodging establishment three stories or more in height and requires a certificate, filed at first licensing and every three years after, that its balconies, platforms, stairways and railways have been inspected by a person competent to conduct such inspections and are free of defects. It goes to the Division of Hotels and Restaurants and to the county or municipal building authority, and the filing follows the establishment, so which of the three associations here is responsible depends on which one governs the residence.

Why do residences here answer to different associations?
Because three separate condominiums were created under one name. State records carry associations filed in April 1986, April 1991 and November 1992, all still active, and the third holds its own recorded common area parcel. The county roll files the residences the same way, in three parcel-number series of twenty-eight, thirty-two and twenty-four, so a buyer can tell from the parcel number which set of documents governs. A budget, a reserve schedule or a rule from one says nothing reliable about the other two.
Is the golf ground beside Tivoli by the Sea part of the community?
No. The county roll places the fairways reaching the community on two sides inside the Baytowne Golf Course parcel, owned by the resort's corporate owner. The residences hold an outlook across it, and access to play is a matter of the resort company's own arrangements rather than anything the community owns.
Does owning here come with beach access?
Not as a property right. The master association states in its published beach notice that it owns none of the beach area and none of the parking parcels, and that access reaches owners and guests through easements from the resort company and the upland property owners, with some stretches reserved to particular communities. The resort company sells beach service and beach club admission as memberships of its own. Confirm current terms with the master association and the resort directly.
