Magnolia Park is recorded as two plats along Bent Arrow Drive in Destin, and they describe two different kinds of property. The first, titled Magnolia Park Phase I, calls itself a 41 lot planned unit development. The Destin City Council approved it for recording in November 1996, and it sits in Plat Book 17 at page 22. Its lots fall in two blocks: twenty in Block A along the north side of Bent Arrow Drive, and twenty-one in Block B on the south side, where two cul-de-sacs, Panther Court and Wildcat Court, reach into the block. Beach Drive runs along the plat's west line; Skeeter Subdivision, Indian Hills and Legion Cove share its north line; and the Indian Oaks additions lie beyond its east end. Okaloosa County's roll puts all 41 lots in its single-family class.

Magnolia Park Phase 2 adjoins the east end of Phase I on the south side of Bent Arrow Drive. Its plat, approved by the council in October 1998 and filed in Plat Book 18 at page 61, describes a 53 unit townhome development in nine lettered blocks, its lots drawn 22 feet across and the ground between buildings labeled common area. Legion Village Townhomes lies along its east line. The county roll carries 53 townhouse parcels there, and its address records place every one at 150 Bent Arrow Drive, distinguished only by unit number.

The two plats handle their streets in opposite ways, and the difference is written on each sheet. The Phase I dedication gives all streets, roads, thoroughfares and easements shown on it to the public. The Phase 2 dedication makes no public dedication at all: its roadway is private, to be maintained by the Magnolia Park Townhome Owners' Association without recourse to the City of Destin. Apart from the lots, the county roll carries one parcel in each phase under its residential common-area class.

Who is responsible for the private road inside the Magnolia Park townhomes?

The Phase 2 plat answers it in its dedication. It states that no property is dedicated to the public, that the roadway within the subdivision shall be a private roadway, and that the Magnolia Park Townhome Owners' Association is to maintain it without recourse to the City of Destin or any other public agency. Florida's corporate registry shows that association with a filing date of September 23, 1998 and an active status. The Phase I plat goes the other way and dedicates its streets to the public.

Do the Magnolia Park townhomes have their own street addresses?

They share one. Okaloosa County's site address records place all 53 townhome parcels in Phase 2 at 150 Bent Arrow Drive, Destin 32541, numbered as units 1 through 53, and the city's development order index files the Magnolia Park project under that same address. The Phase I houses are numbered separately along Bent Arrow Drive, Panther Court and Wildcat Court. When pulling county records for a townhome, search by unit or parcel number rather than by the street number.

Were the Magnolia Park townhomes built at the same time as the Phase I houses?

They overlap without running in step. On the county roll the 41 Phase I houses carry actual build years from 1997 to 2003; Block A, north of Bent Arrow Drive, was mostly done by 2000, while most of Block B, which holds both cul-de-sacs, dates from 2001 or later. The townhomes in Phase 2 went up block by block: A, B and D around 2000, C, E, F and I in 2002, and G and H in 2003.

Why can one Magnolia Park lot and block number point to two different homes?

Both plats use lettered blocks and both start with Blocks A and B, so a lot and block alone can match a Phase I house and a Phase 2 townhome. Phase I, in Plat Book 17 at page 22, holds 41 lots in Blocks A and B. Phase 2, in Plat Book 18 at page 61, holds 53 townhome lots in Blocks A through I. The county roll keeps them apart by naming the phase in every legal description, and a contract or survey should do the same.
