Old Bay is a 6.48-acre replat in the City of Destin, Okaloosa County, marked on its vicinity map between Airport Road and Emerald Coast Parkway, with Mattie M. Kelly Boulevard running down its western side in a 50-foot right-of-way. Bonezzi Development Company dedicated the plat as Old Bay Townhomes of Destin, a replat of Old Bay Village, and the county clerk filed it on June 30, 2004, in Plat Book 21, pages 49 and 50. The replat lays out 56 townhouse lots, each 83.21 feet deep and about 20 feet wide, in rows separated by common area, plus a Lot 57 labeled Old Bay Village Condominium. The county roll lists an 18-unit Old Bay Condo, units 101 through 306, and gives every one of those units and all 56 townhouses a 2005 year built.

The dedication gives the public only that right-of-way and a 20-foot pedestrian easement, and no other street, alley, easement or common area. The pedestrian easement runs through the common ground south of the southern row, and the plat's south line follows the southerly edge of a 100-foot Gulf Power easement recorded at Official Records Book 148, page 99. Between the rows the drawing shows strips labeled variable-width utility and access easements, and general note 8 gives all lots cross access through the common areas, plus a drainage and utility easement over and under all of the common areas.

The county roll names the Old Bay Village owners association as owner of the 3.03-acre common area, and a separately named corporation, Old Bay Condominium Owners' Association, Inc., filed with the state on May 11, 2005, is listed as active. No record reviewed here shows whether a declaration of covenants was recorded for these lots or which association a given townhouse or unit belongs to, and the plat's statutory notice warns that restrictions not drawn on it may be found in the county's public records. Ask the seller and closing agent for any recorded declaration and each association's budget.

On the interactive zoning map the city links from its Zoning page, a lookup inside a townhouse lot and one inside the condominium parcel both show Residential, Office, Institutional, Village Residential (ROI-VR). That district's factsheet names permanent single-family detached homes as its purpose and lists multi-family attached dwellings only as a conditional use, while calling itself an excerpt not meant for zoning decisions. Before planning a rebuild or addition, ask the city's planning division how the existing buildings are classed.

Is Old Bay in an airport noise zone?

It may be, and the plat raises the question itself. The recorded replat carries a City of Destin notice that the properties it identifies are or may be within Noise Zone C of the airport it names as the Destin-Ft. Walton Beach Airport. The notice does not settle it: the determination is to come from the City of Destin, and a disclosure statement is to be completed and filed with the deed for residential property inside Zone C. Before closing, ask the city for its written determination on the specific lot or unit, and ask the closing agent whether an earlier deed carried that disclosure.

Can an Old Bay townhouse or condo be a short-term rental?

Plan on no until the city says otherwise in writing. Destin requires short-term rental properties to register with the city and to register again every year. The city's short-term rental answers list the districts where it generally allows them and send readers to its zoning map to find a property's district. Looked up inside an Old Bay townhouse lot and the condominium parcel, that map shows ROI-VR, which is not on the list, and the ROI-VR factsheet says the district is meant specifically not to hold seasonal dwellings or commercial transient living accommodations. Get the planning division's answer for the parcel before counting on any short-term use.

Is Old Bay still in flood Zone X?

The recorded plat can only say what a 2002 map showed. General note 5 on the replat states that, on the National Flood Insurance Program map panel 125158 0488 H dated December 6, 2002, the described property lies in Zone X. A note on a 2004 plat is not a current determination, so look up the specific address on FEMA's current flood map and have an insurer quote the actual building before relying on that zone.

Can you build a fence or patio on an Old Bay townhouse lot?

Read the plat before planning either one. On the southern row, its second sheet draws the north line of a 100-foot Gulf Power easement across Lots 33 through 56, inside their south lot lines, and dimensions the gap at 7.27 feet at the south corner Lots 55 and 56 share; elsewhere the line is drawn but not dimensioned. South of those lots the easement lies over common area. Before adding a fence, patio or planting on a southern-row lot, order a survey and read the easement instruments the plat cites, Official Records Book 148, page 99, and Book 239, page 603.
