Living in Old Florida Beach

Old Florida Beach is one recorded plat rather than a district. St. Joe Paper Company filed it on 27 November 1991 at Plat Book 9, Page 17 of the Walton County public records, and its lots run to number 68 along Old Beach Road, Boardwalk Lane and Draper Lane, roughly 900 feet south of Scenic 30A on the ground between the Gulf and Draper Lake. Rear alleys serve much of it. The declaration hands the association the streets, the alleys, the retention and drainage areas, the pedestrian access easements and Lot 61 together with whatever stands on it. Those pedestrian easements are the beach arrangement: shown on the recorded plat, limited to owners, restricted to non-commercial activity for beach access only, with loitering barred and the right delegable to immediate family and to guests temporarily occupying a permanent structure on a lot. Building here is reviewed rather than improvised, and the detail is unusually specific for a plat this size. As recorded, the declaration seats a four person Architectural Review Committee chosen by the declarant, and no building, fence, wall, driveway, patio, pool, antenna or flagpole may be erected or altered, and no grading, excavation or tree removal begun, until it has passed on a site development plan, architectural plans and a landscape plan. It sets front yards at 15 feet and rear at 30, caps a garage footprint at 22 by 26 feet, requires porches across at least three quarters of the street front ground floor and at least 7 feet deep, allows metal or shingle roofing at a 4:12 minimum pitch, bars aluminum finished and jalousie windows and sliding doors, and rules out slab foundations. Lots must keep 15 percent of their area in existing native vegetation with a quarter of that in the front yard, except on waterfront lots carrying a control line or building restriction line, where the instrument expressly supersedes that requirement with 500 square feet of existing native vegetation in the street front yard and makes everything waterward of the line a total preservation zone open only to an approved dune walkover, a rule it ties to Choctawhatchee beach mouse habitat. County mapping adds one more line across the plat: 16 of its 70 county-addressed sites fall inside the mapped 300 foot protection zone around Draper Lake, where a land clearing permit comes before a shovel and armoring the shore is prohibited outright. There is no commerce inside the plat. The nearest public parking, restrooms and seasonal lifeguard are at the Gulfview Heights regional access, roughly 750 feet west of the middle of the plat and under 200 feet from its westernmost lots, and Gulf Place is about three quarters of a mile west along 30A, with Blue Mountain Beach about a mile and a quarter the other way.

Yes, and it is the same committee for every lot on the 1991 plat. As filed, the Declaration of Covenants seats a four person Architectural Review Committee chosen by the declarant and requires its approval, in writing within thirty days, before any building, fence, wall, driveway, patio, pool, antenna or flagpole goes up or changes, and before any grading, excavation or tree removal starts. It also bars an owner from asking a regulatory agency for a variance without prior written approval. Two limits belong with that: the instrument captured here is the 1991 original, whose own duration clause ran to the end of 2011 and renews in five year periods unless a majority of owners record otherwise, and it permits amendment by the declarant to cure ambiguity or, with the consent of 75 percent of owners, in any other respect. No recorded amendment was reachable, so treat the committee's present make-up and current practice as something to confirm during diligence.

How do owners at Old Florida Beach reach the sand?

Through pedestrian access easements shown on the recorded plat. The declaration limits their use to owners, restricts it to non-commercial activity for beach access only, confines foot traffic to the constructed walkways, and lets an owner extend the right to immediate family and to guests staying in a permanent structure on a lot. It is appurtenant to lot ownership and cannot be separated from it. The nearest public alternative is the Gulfview Heights regional access, roughly 750 feet west of the middle of the plat, which the county lists with parking, restrooms and a lifeguard.

What can and cannot be built on a waterfront lot here?

The recorded declaration makes everything seaward of the coastal construction control line or the county building restriction line a total preservation zone: clearing, grubbing and construction of any kind are prohibited there and only an approved dune walkover is allowed, a rule the instrument ties directly to Choctawhatchee beach mouse habitat. Landward of that line the ordinary plat rules apply, with one substitution the instrument makes expressly for these lots: in place of the 15 percent of lot area in existing native vegetation required elsewhere on the plat, a waterfront lot with a control line or building restriction line must preserve 500 square feet of existing native vegetation in the street front yard, and the declaration states that this requirement supersedes the 15 percent rule for those lots. A cap on how far the first floor may sit above existing grade applies as well. On where that line actually falls: the declaration states what the covenant requires and does not locate either line itself, but Florida's environmental department maps Walton County's 2009 coastal construction control line along this plat's southern edge, so the zone is live ground here rather than a general reference. How far off the front row it actually runs is not something this page publishes, because the line is mapped as a coarse path and an address point is not a lot line. A mapped line and a filed address point are not the same thing, so have a surveyor place it on the specific lot before planning anything near the seaward edge. At the eastern end of the plat a second and separate constraint applies, because Walton County's mapped 300 foot Draper Lake protection zone reaches 16 of the plat's addressed sites.
